<p>With the <a href="http://ayersteam.com/real-estate-blog/two-important-short-sale-related-federal-actsprograms-ending-12312012/">HARP/HAMP programs and the Mortgage Forgiveness Debt Relief Act </a>officially ending on Dec 31, 2012 (no plans as of today to extend it), BofA and Chase are steamrolling forward to get these distressed properties off of the books.</p>

			<content:encoded><![CDATA[<p><img class="alignleft size-thumbnail wp-image-3895" title="FHFA_Logo" src="http://ayersteam.com/wp-content/uploads/FHFA_Logo-115x115.jpg" alt="FHFA Logo" width="115" height="115" />The Federal Housing Finance Agency announced a new policy to speed up the process that mortgage servicers use to handle short sales, deeds-in-lieu, and deeds-for-lease for mortgages that are backed by Fannie Mae and Freddie Mac.   BofA announced that they are speeding up short sales as <a href="http://ayersteam.com/real-estate-blog/bofa-announces-shortened-short-sale-process-april-14-2012/">posted here</a>.  Chase, Wells Fargo and others are following suit as well.</p>
<p>The FHFA, the regulator of Fannie and Freddie, says the new policy includes a revised timeline that will require mortgage servicers to respond to a request for a short sale offer within 30 days. Servicers also will be required to make a final decision on the short sale offer within 60 days.</p>
<p>For any short sale offer still under review after 30 days, banks will be required to provide weekly status updates to borrowers regarding the pending short sale offer.</p>
<p>The new policy, which will roll out in stages starting in June, aims to “prevent foreclosures, keep homes occupied, and help maintain stable communities,” says Edward DeMarco, the FHFA’s acting director. “These timeline and borrower communication announcements set minimum standards and provide clear expectations regarding these important foreclosure alternatives.” </p>
<p>The FHFA also says that by the end of the year there will be additional announcements from Fannie and Freddie that are aimed at addressing borrower eligibility and evaluation, simplifying documents, property valuation, fraud mitigation, payments to subordinate lien holders, and mortgage insurance.</p>

<p>As part of my <a href="http://ayersteam.com/about-us/designations/">CDPE and SFR Designations</a>, I am invited to various Industry calls regarding short sales and foreclosures and the ever-changing processes that the major banks follow.</p>
<p>Bank of America announced today it is refining its short sale process to streamline its approval process and reduce the wait in accepting offers and making it to closing. The changes are expected to trim the bank’s decision time in half &#8212; <strong>from 45 days or longer to 20 days. </strong></p>
<p>Starting April 14, the bank says it will permit its short sale specialists, using a third-party platform called Equator, to complete document collection, valuations, and underwriting at the same time, which is expected to help speed the process.  </p>
<p>Bank of America also announced starting April 14 that real estate agents will be required to submit five documents in short sale transactions to be considered by the lender. These required documents include: </p>
<ul>

<li>HUD-1</li>

<li>Bank of America Short Sale Addendum</li>

<p>To be honest, I NEVER market a home for a 6% fee.  I think it is just too damn high.  I tend to aggregate around an average 5% or so.  But, I like to run specials, so here it is! </p>
<p><span style="color: #000080;"><strong>If you list your home with The Ayers Team between April 1st, 2012 and June 30th, 2012</strong></span>, our <span style="color: #000080;"><strong>Marketing Fee</strong></span> is only <span style="color: #000080; font-size: medium;"><strong>4%</strong></span>. </p>
<p>We will even pay for a professional cleaning company to come in right before we place your home in the market (cost not to exceed $100).</p>
<p>If you want to sell your home as a Short Sale, we do charge 6% as allowed by FNMA Guidelines.  BUT, <strong>these fees are paid by your lender</strong> as part of the transaction.  They are NOT borne by you as the seller.</p>

			<content:encoded><![CDATA[<p><img class="alignleft size-thumbnail wp-image-2434" title="Short Sale Approval 2" src="http://ayersteam.com/wp-content/uploads/Short-Sale-Approval-2-115x115.jpg" alt="Short Sale Approvals" width="115" height="115" />  As part of a settlement with state attorneys general, the five largest mortgage servicers are adopting new requirements for short sales, which is expected to speed-up what has been known as a lengthy process.  We are seeing a short sale process ourselves, so we hope this holds true!</p>
<p> </p>
<p>Here are some of the new requirements for servicers under the settlement: </p>
<ul>
<li>Servicers must provide borrowers with a decision within 30 days after receiving a short sale package request. </li>
<li>Servicers will be required to notify a borrower, also within 30 days, if any necessary documents are missing to process the short sale request. </li>
<li>Servicers must notify a borrower immediately if a deficiency payment is needed to approve the short sale. They also must provide an estimated amount for the deficiency payment needed for the short sale. </li>
<li>Servicers are also required to form an internal group to review all short sale requests. </li>
<li>Banks will be considered in violation of the settlement requirements if they take longer than 30 days on more than 10 percent of the short sale requests. Violations can carry fines of up to $1 million and $5 million for repeat offenses. </li>
